{"id":1752,"date":"2008-07-23T10:36:00","date_gmt":"2008-07-23T10:36:00","guid":{"rendered":"https:\/\/elizaphanian.com\/?p=1752"},"modified":"2008-07-23T10:36:00","modified_gmt":"2008-07-23T10:36:00","slug":"we-are-all-dave-walkers-now","status":"publish","type":"post","link":"https:\/\/elizaphanian.com\/?p=1752","title":{"rendered":"We are all Dave Walkers now"},"content":{"rendered":"<p>Dave Walker is <a href=\"http:\/\/cartoonchurch.com\/blog\/\">the Cartoon blogger<\/a>, and currently cartoonist in residence at the Lambeth conference. He&#8217;s also a really good bloke, who has been, over the last several months, exposing the incompetence and injustice of the people who have taken over the SPCK chain. They have now come down with heavy hobnailed boots upon him, and served a &#8216;cease and desist&#8217; order against him, with which he has complied.<\/p>\n<p>Several people have written about this &#8211; see a list <a href=\"http:\/\/www.mattwardman.com\/blog\/2008\/07\/23\/my-name-is-dave-walker-people-posting-about-mark-brewers-cease-and-desist-notice\/\">here <\/a>&#8211; (see also my comment on Peter Kirk&#8217;s blog <a href=\"http:\/\/www.qaya.org\/blog\/?p=588\">here<\/a>) but it seems to me that there are several serious issues about free speech at stake.<\/p>\n<p>I suggest that those who have sympathy with Dave and wish to show solidarity with him should search the google cache for Dave&#8217;s posts about SPCK and re-post samples on their own blogs. <\/p>\n<p>Like this:<\/p>\n<div>\n<h1><b>SPCK<\/b> \/ SSG Bookshop Posts<\/h1>\n<p><b>This page contains <b>Cartoon<\/b> <b>Blog<\/b> entries which relate to the former <b>SPCK<\/b> bookshops now operated by the St Stephen the Great Charitable Trust. Many of those visiting have been mourning the death of Steve Jeynes, the Worcester bookseller, who, judging from the comments <a href=\"http:\/\/www.cartoonchurch.com\/blog\/2008\/06\/27\/spck-ssg-tragic-news-from-worcester\/\">posted<\/a> on this site was loved by many. In the circumstances the usual nonsense that I write on this site has not seemed appropriate, hence my silence.<\/p>\n<p>The memorial service for Steve Jeynes took place yesterday. The Worcester News has a report: <a href=\"http:\/\/www.worcesternews.co.uk\/news\/local\/3197116.Tributes_paid_to_exceptional_man\/\">Tributes paid to exceptional man<\/a>. Doug Chaplain was there and has <a href=\"http:\/\/www.metacatholic.co.uk\/2008\/07\/steve-jeynes-memorial-service\/\">written<\/a> about it. I have one more bookshop-related thing that I need to post about which has arisen as a result of a comment (not yet visible) on this site on Sunday morning. This note was sent out today to clergy within the Diocese by the Communications department:<\/p>\n<blockquote>\n<p>I am very sorry to tell you that Steve Jeynes, has been found dead, apparently having taken his own life. There will apparently be a \u2018meeting of creditors\u2019 on 22 July in Houston. <\/p>\n<p>Having done a quick search I notice that there was, on 18 June a \u2019status conference\u2019 for St Stephen the Great LLC in the bankruptcy court (this can be found on a cached Google page saved <a href=\"http:\/\/www.weblogcartoons.com\/cb\/bits-bobs\/ssg-court.htm\">here<\/a>). Information on the chapter 11 bankruptcy process can be found via this page: <a href=\"http:\/\/www.uscourts.gov\/bankruptcycourts\/bankruptcybasics\/chapter11.html\">Chapter 11 &#8211; Bankruptcy Basics<\/a><\/p>\n<p>All of this must be seen in the light of <a href=\"http:\/\/www.cartoonchurch.com\/blog\/2008\/06\/24\/usdaw-press-release-about-the-former-spck-shops\/\">Usdaw\u2019s statement yesterday<\/a>, now <a href=\"http:\/\/www.usdaw.org.uk\/retailnonfood\/news\/1214296044_17364.html\">available on the Usdaw website<\/a>:<\/p>\n<blockquote>\n<p>Usdaw firmly believes that the bankruptcy proceedings in the US have no effect in the UK, because this is a UK company with entirely UK-based assets and activities.<\/p>\n<\/blockquote>\n<p>Also, from John Hannett, the General Secretary of Usdaw:<\/p>\n<blockquote>\n<p> These loyal staff are being given misleading information about these US bankruptcy proceedings and the effects this may have on their rights to take legal action in the UK. Our fear is that the Brewers\u2019 actions may be an attempt to move assets away from the business and out of the reach of our members with legitimate claims.<\/p>\n<p>\u201cWe will carry on as before with the claims against the Brewers who are accumulating wealth whilst riding roughshod over hard working employees. We will continue to assist all our members affected by this messy situation and work to rectify it as soon as possible.\u201d<\/p>\n<\/blockquote>\n<p><strong>Employees not paid<\/strong><br \/>On a related note some (all?) of the people who work or worked in the shops have not been paid today (the 25th) as they would usually be. See for instance <a href=\"http:\/\/www.cartoonchurch.com\/blog\/2008\/06\/24\/usdaw-press-release-about-the-former-spck-shops\/#comment-233493\">these <b>blog<\/b> comments<\/a>. [Update: some employees have now been paid]<\/p>\n<p><strong>Telegraph <b>blog<\/b> post<\/strong><br \/>Christopher Howse (who wrote Saturday\u2019s <a href=\"http:\/\/www.cartoonchurch.com\/blog\/2008\/06\/21\/former-spck-bookshops-in-the-telegraph\/\">comment piece<\/a>) has written on his Telegraph <b>blog<\/b> about the Orthodox church in Poole: <a href=\"http:\/\/blogs.telegraph.co.uk\/christopher_howse\/blog\/2008\/06\/24\/orthodox_exodus\">Orthodox Exodus<\/a>. The Union has over 50 members at the bookshops and is expecting that the number of employment tribunal claims will rise.<\/p>\n<p>The Brewer brothers were gifted the St. Stephen the Great Christian bookshops in 2006 by <b>SPCK<\/b>.  The chain includes 23 bookshops, many of which are historic buildings in prime retail positions.<\/p>\n<p>Following the change of ownership, a new contract was drawn up increasing the working week from 37.5 to 40 hours with no additional pay, turning all part-time staff into casual staff with no guaranteed hours every week and taking away all rights to company sick pay.<\/p>\n<p>Now, virtually all Usdaw members have been dismissed with no notice, some by email, and have received little or no information about what this means for their rights and their pay.<\/p>\n<p>The Brewer brothers have now filed St. Stephen the Great for bankruptcy in the US. Usdaw firmly believes that the bankruptcy proceedings in the US have no effect in the UK, because this is a UK company with entirely UK-based assets and activities. Staff have been told that they can apply for jobs with ENC Management Company, which is also owned by the Brewers, but that they no longer have jobs with St. Stephen the Great.<\/p>\n<p>Usdaw is also aware that the Charity Commission has been alerted to these actions because of its role in regulating the activities of the linked charity, St. Stephen the Great Charitable Trust.<\/p>\n<p>John Hannett, Usdaw General Secretary, stated:<\/p>\n<p>\u201cIt is clear that staff, many of whom have been long standing loyal workers, have been mistreated and many are understandably very upset and concerned. We are very concerned at a new company (ENC Management Company) being set up in these circumstances, while our members are losing their jobs. These loyal staff are being given misleading information about these US bankruptcy proceedings and the effects this may have on their rights to take legal action in the UK. Our fear is that the Brewers\u2019 actions may be an attempt to move assets away from the business and out of the reach of our members with legitimate claims.<\/p>\n<p>\u201cWe will carry on as before with the claims against the Brewers who are accumulating wealth whilst riding roughshod over hard working employees. It sounds as if it is by someone working in the York shop. I thought there might be as I was telephoned.)<\/li>\n<\/ul>\n<p><strong><br \/>Closures and openings<\/strong><\/p>\n<ul>\n<li>We think that the shops that have closed since the bankruptcy announcement are:<br \/>Birmingham, Canterbury, Chester, Exeter, Newcastle, Norwich (closing on June 14) Worcester, York.
